Uber - Adultwork - Workers Rights

A Uber driver has taken the taxi app company to court over claims that it does not provide him with basic workers' rights, he argues they should be entitled to holiday pay and receive at least the national minimum wage.

There are two drivers that are taking the court action but the end result could effect all Uber drivers and cost the company millions of pounds and probably cost many drivers their jobs. Prices would go up as demand would go down.

They are claiming to be employees of Uber and are claiming they should be given minimum wage as well as holiday & sick pay. I would be very surprised if they win the case, as apart from effecting Uber drivers it could effect many other types of self employed workers.

But should they win, how could that effect Adultwork if a cam girl decided that she would take tem to court over workers rights? (taking that anybody could actually get them into court).

It won't affect Adultwork in the slightest.

To be seen as an employee rather than a self employed contractor you need your hours and days set for you by the company, adultwork do no such thing; I wasn't aware Uber have been doing that either... if they have at all.

That is why I do not think they would win the case, Uber drivers work hours to suit themselves, much like Adultwork, you clock on when you want and get work when you are seen to be available.

But the courts have been known to make bizarre decisions.

The action is only being taken by two drivers, I am sure most of the drivers are more than happy with the flexibility the system allows them.

From the article I found, one of the drivers is complaining that after expenses (I'm assuming things like road tax, insurance, MOT, petrol, any parking fees etc) he's making less than minimum wage per hour for the time he puts in. Which, is tough titty, that's self employed life. It is also noted that within a specific time frame he turned down a number of jobs, which is his choice; but you can't complain about averaging less than minimum wage if you don't put the shift in to reflect a minimum wage. I suspect it'll be thrown out of court.

I think he just lost his case on the above...

You can't turn down jobs if you are employed or you would be sacked.

I am sure there are some girls that do web cam that may not make the min wage on some shifts but do well on others.

As an escort I have had bad days (not many) when I hardly covered my expenses (hotel & travel) for a couple of days, like you say, that's part of being self employed, although his claim is he is not.

The trouble is if somebody like that wins a case it sets a precedent for all types of work that work on the same principles.
